Terms & Conditions for Real Estate Auction:

PLEASE CAREFULLY REVIEW THESE REAL ESTATE AUCTION TERMS BEFORE SUBMITTING A BID. IF YOU DO NOT UNDERSTAND OR AGREE TO THESE TERMS, DO NOT BID. BY PLACING A BID, YOU ACKNOWLEDGE THAT YOU HAVE READ AND ACCEPT THESE TERMS AND THAT YOU ARE ENTERING INTO A LEGALLY BINDING AGREEMENT TO PURCHASE THE PROPERTY ACCORDING TO THE CONDITIONS BELOW:

ONLINE RESERVE AUCTION ONLY: BIDDING PERIOD: Opens July 15, 2025, at 8:00 AM CST and ends July 21, 2025, at 6:00 PM CST (see details under "Auction Closing Procedures"). A 3% buyer’s premium will be added to the final bid amount (see full terms). The property is offered in a single tract. Each bid submitted is an offer to purchase, and upon seller acceptance, becomes a legally enforceable contract. This auction is subject to a reserve, meaning the property will not sell unless the minimum price set by the seller is met. The auctioneer will resolve any bidding disputes, and their decisions are final.

AFTER THE AUCTION CLOSES: The seller may accept or reject any and all bids. Once the auction concludes, the winning bidder will be contacted by a representative of Base Camp Country Real Estate to execute the purchase agreement. The buyer must return the signed contract and remit the specified non-refundable earnest money deposit. This deposit will be held in escrow and credited to the buyer at closing. Wire instructions and escrow documentation will be provided. The buyer is responsible for all transfer fees. If the buyer fails to execute the contract and fund the escrow account by 4:00 PM on July 25, 2025, they will be deemed in default.

In the event of a default, the buyer may be liable for damages including, but not limited to, costs of resale, holding costs, legal fees, and the difference between the final auction price and resale amount. Both seller and Base Camp Country Real Estate retain the right to enforce the agreement or pursue damages.

REAL ESTATE SALE TERMS:

  • Buyer’s Premium: 3% added to final winning bid.
  • Earnest Money: 10% of the total purchase price due upon signing the contract. Remainder due at closing.
  • Financing: Purchases are not contingent on financing.
  • Inspections and Contingencies: The sale is not subject to inspections, surveys, appraisals, or financing approval.
  • Acreage: Property acreage is approximate, based on public records.
  • Closing Date: Scheduled for no later than August 31, 2025. Seller may extend this deadline if necessary.
  • Open House Dates: July 2, 2025 (4:00 PM - 7:00 PM CST) and July 14, 2025 (1:00 PM - 5:00 PM CST).
  • Possession: Granted at closing.
  • Personal Property: Excluded from the sale.
  • Real Estate Taxes: Prorated to the date of closing.
  • Survey: Seller may determine need for survey. If required, cost split equally between buyer and seller.
  • Deed: Seller will convey title via General Warranty Deed.
  • Closing Fees: Closing fee and title insurance fee will be split 50/50 between seller and buyer
  • Title: Seller to provide Owner’s Title Insurance. Buyer responsible for lender’s policy if required.
  • Easements & Zoning: Property sells subject to existing easements and local zoning regulations.
  • Visual Aids: Images and maps are for reference only and not a legal survey.
  • Mineral Rights: All owned mineral rights will transfer to the buyer.
  • Property Inspection: Buyers are responsible for their own inspections and due diligence. Entry onto property is at buyer’s own risk.
  • Agency: Base Camp Country Real Estate represents the seller.
  • Bid Rigging Warning: Any agreement to suppress bids is illegal and will be reported to authorities. Violations carry severe penalties.

BIDDING AND REGISTRATION:

  • Verification: Base Camp Country Real Estate may deny bidding rights based on questionable credentials.
  • Username Responsibility: Bidders are accountable for all actions under their account.
  • Conduct: All applicable laws must be followed. Violations may lead to disqualification.

AUCTION CLOSING PROCEDURES:

  • Auto Extend: If a bid is placed in the final 5 minutes, the auction extends by 5 minutes. This continues until no additional bids are placed for 5 minutes.

TECHNICAL ISSUES:

  • If technical issues arise, Base Camp Country Real Estate may extend, suspend, or cancel bidding. Neither the auction platform nor Base Camp Country Real Estate are responsible for missed bids.

CONDUCT OF AUCTION:

  • Minimum bid increments: $1,000.
  • Base Camp Country Real Estate reserves the right to reject any bids, cancel the auction, or remove properties at its discretion.
